Phoenix Home Care accused of not complying with settlement agreement over death of girl

ST. LOUIS — The parents of a deceased patient have filed a lawsuit against Phoenix Home Care for alleged breach of a settlement agreement.

Sarah Goble and Joshua Jacobowitz filed a complaint on July 18 in the St. Louis City Circuit Court, alleging that the defendant failed to perform its obligations under the agreement.

According to the complaint, the plaintiffs allege that they negotiated a settlement with the defendant for a confidential amount due to the untimely death of their daughter. To date, the plaintiffs have not receive the proceeds as disclosed on the settlement sheet. The plaintiffs hold the defendant responsible for allegedly failing to pay the plaintiffs as agreed.

The plaintiffs request a trial by jury and seek an order for the approval for the said wrongful death settlement. They are represented by Steven M. Gelfman of Hoffman & Gelfman Attorneys PC in St. Louis.
