Google, On the Map Inc. accused of violating telephone harassment rules

ST. LOUIS — A business owner has filed a class-action lawsuit against an internet marketing company and online advertising firm, citing alleged violation of telephone harassment statutes.

Todd A. Mandel filed the complaint on July 18 in the St. Louis City Circuit Court against On the Map Inc. and Google Inc., alleging that they violated the Telephone Consumer Protection Act (TCPA).

According to the complaint, the plaintiff alleges that he received calls on his cellular phone with a pre-recorded voice that advertised the ability to have his law firm's website be the first page of Google search results. The plaintiff claims that he never expressly consented to receiving telephone calls on his cellular phone from any of the defendants. 

The plaintiff holds the defendants responsible for allegedly using an automatic telephone dialing system or an artificial or prerecorded voice while calling him and made one or more telephone calls to him without consent.

The plaintiff requests a trial by jury and seeks to award damages of $500 per call, treble damages up to $1,500, attorneys' fees, costs, expenses and all other relief deemed just. He is represented by Jeremy A. Gogel of the Gogel Law Firm in St. Louis.
