Missouri Seventeen Properties LLC, others accused of failing to keep handrails safe

ST. LOUIS — A resident is suing property owners and operators for allegedly failing to keep stairway handrails safe.

Thomas Brooks filed a complaint on July 18 in the St. Louis City Circuit Court against Missouri Seventeen Properties LLC, SC Flicks LLC, Janice L. Vails and Carla Herman, alleging that the defendants failed to exercise ordinary care in maintaining and keeping their premises safe for the public.

According to the complaint, the plaintiff alleges that he was using a handrail for assistance while walking on the outdoor stairway to his apartment on May 27, 2016  when the handrail gave way and broke, causing him to fall off the stairs to the ground and sustain injuries.

The plaintiff holds the defendants responsible for allegedly failing to properly install and maintain the handrail, warn of the unsafe conditions of the handrail and barricade around the handrail or otherwise prevent tenants from using it.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $25,000 for costs incurred, interest and for all such other relief the court deems just. He is represented by Noland D. Drafahl of Goldblatt + Singer in St. Louis.
