Woman claims Dubuque Paint Equipment driver's negligence resulted in crash

ST. LOUIS — A Missouri motorist is suing a company and its drivers, citing alleged negligence.

Linda Gartner filed a complaint in the U.S. District Court for the Eastern District of Missouri against Dubuque Paint Equipment Services Inc., Kim Rose, Roy Brice and KLLM Transportation alleging that Ross and Brice failed to exercise the highest degree of care for the safety of other motorists on the road.

According to the complaint, the plaintiff alleges that on Sept. 12, 2016, she was driving her vehicle when it was hit from behind by a vehicle driven by Ross. She sustained serious and permanent injuries to her neck, head and back resulting in pain and suffering and discomfort and incurred medical expenses. The plaintiff holds the defendants responsible because Ross and Brice allegedly negligently operated their vehicle at an excessive speed, failed to yield right of way and failed to maintain a careful lookout.

The plaintiff requests a trial by jury and seeks damages in excess of the jurisdictional limits of the court, plus interest, litigation costs and all other relief that are appropriate. She is represented by Brent E. Labowitz of Defeo & Kolker LLC in Clayton.
