ST. LOUIS — A retail mortgage adviser is suing employers, citing alleged violation of workers' compensation acts.

David Nappier filed a complaint July 28 in the U.S. District Court for the Eastern District of Missouri Eastern Division against Stonegate Mortgage Corp. and Home Point Financial Corp. alleging that the successor employers violated the overtime pay provisions of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked more than 40 hours per work week for the defendants without receiving proper overtime compensation. The plaintiff holds Stonegate Mortgage and Home Point Financial responsible because the defendants allegedly willfully failed to pay him for overtime hours worked.

The plaintiff requests a trial by jury and seeks compensatory and liquidated damages, plus interest, attorneys' fees and costs and any further relief as the court deems just and proper. He is represented by James G. Nowogrocki and Morgan L. Taylor of Weiss Attorney at Law PC in St. Louis.
