ST. LOUIS — A St. Louis consumer has filed a class-action lawsuit against a windshield wiper fluid manufacturer, citing alleged breach of warranty.
Paul Weishaar, individually and on behalf of all others similarly situated, filed a complaint in the St. Louis 22nd Judicial Circuit Court against South/Win Ltd., alleging the company violated the Missouri Merchandising Practices Act.
According to the complaint, the plaintiff alleges he was forced to spend money to repair his vehicle's windshield wiper fluid's system as a result of the defendant's defective product. The plaintiff holds South/Win Ltd. responsible because the defendant allegedly falsely advertised its product would protect the vehicle's windshield wiper fluid system from freezing temperatures.
The plaintiff requests a trial by jury and seeks an order certifying this case as a class action and appoint plaintiff and his counsel as representatives, award for all damages, attorney's fees, costs and interest and all other relief deemed just.
