St. Louis-area residents claim Roundup caused non-Hodgkin lymphoma

Medical malpractice 06

ST. LOUIS — St. Louis-area consumers are suing the manufacturer and distributor of Roundup, citing alleged design defects and failure to warn users of its product's harmful effects.

Barbara Bates, Ernest Achuleta, Stephanie Augello, et al. filed a complaint in the St. Louis 22nd Judicial Circuit Court against Monsanto Co. alleging that the defendant failed to warn users of its product's harmful effects.

According to the complaint, the plaintiffs allege that they have suffered injuries due to exposure to Roundup. The product allegedly contains the active ingredient glyphosate and polyethoxylated tallow amine, which are allegedly dangerous to human health. The plaintiffs claim that the decedents were diagnosed with chronic non-Hodgkin lymphoma.

The plaintiffs hold Monsanto responsible because the defendant allegedly failed to investigate, study, test or promote the safety or to minimize the dangers to users and consumers of its product, and failed to exercise reasonable care to warn customers of the dangerous risks associated with the use and exposure to Roundup.

The plaintiffs request a trial by jury and seek judgment for compensatory damages in the amount to be proven at trial, exemplary damages, costs including attorneys' fees, court costs, other litigation expenses and such other and further relief as the court deems just and proper. They are represented by Mark R. Niemeyer and Michael S. Kruse of Niemeyer, Grebel & Kruse LLC in St. Louis.
