St. Louis resident claims Circle K falsely advertised wiper fluid

ST. LOUIS — A consumer has filed a class-action lawsuit against Circle K Stores Inc., citing alleged false advertising.

Paul Weishaar, individually and on behalf of all others similarly situated filed a complaint in the St. Louis 22nd Judicial Circuit Court against Circle K Stores, alleging that the Arizona corporation violated Missouri's Merchandising Practices Act.

According to the complaint, the plaintiff alleges the windshield wiper fluid froze even though it was advertised not to. As a result, he was forced to purchase other windshield wiper fluid and had to make repairs to his vehicle's wiper system. The plaintiff holds Circle K Stores responsible because the defendant allegedly falsely advertised that its windshield wiper fluid can protect the vehicle's wiper system to -20 degrees Fahrenheit.

The plaintiff requests a trial by jury and seeks an order certifying this case as a class action and appointing plaintiff and his counsel as representatives, award for all damages, attorney's fees, costs and expenses and any other relief that are just and proper.
