Man claims Monsanto's Roundup causes lymphoma

Medical malpractice 01

ST. LOUIS — An individual is suing Monsanto Co., citing alleged negligence and misleading advertising.

Michael Foy filed a complaint Aug. 9 in the U.S. District Court for the Eastern District of Missouri against Monsanto, alleging that the biotechnology corporation negligently disregarded the public's safety.

According to the complaint, the plaintiff alleges that as a result of his exposure to Roundup, an herbicide containing active ingredient glyphosate and the surfactant polyethoxylated tallow amine, he developed non-Hodgkin lymphoma, a cancer of the lymphatic system. He claims he suffered physical and mental pain, diminished enjoyment of life and hospitalization, and incurred medical expenses.

The plaintiff holds Monsanto responsible because the defendant allegedly negligently manufactured, marketed and sold Roundup, which the suit calls an unsuitable product to human health, and failed to provide adequate warnings and directions to the dangers associated with its use.

The plaintiff requests a trial by jury and seeks compensatory damages, plus interest, costs, attorneys’ fees and all further relief as the court deems proper. He is represented by Jacob A. Flint of Flint Law Firm LLC in Edwardsville and Aimee H. Wagstaff and David J. Wool of Andrus Wagstaff PC in Lakewood, Colorado.
