St. Louis business owner claims his lawyer didn't appear at his trial

ST. LOUIS — A St. Louis business owner is suing his lawyer, citing alleged breach of duty.

Roy Gooden and Daughter Plumbing and Sewer Co. Inc. filed a complaint in the St. Louis 22nd Judicial Circuit Court against Dean Plocher, alleging the defendant failed his duty to appear in trial to represent the plaintiff.

According to the complaint, the plaintiffs allege that on May 12, 2010, the defendant was the legal counsel despite filing a motion to withdraw as counsel to the plaintiff because he allegedly never called up his Motion to Withdraw in open court. Gooden claims he failed to have proper representation during trial, which resulted in him suffering damages in the amount of $112,806.67. 

The plaintiffs hold Plocher responsible because the defendant allegedly failed to appear at trial and failed to mount a defense in the representation of the plaintiffs' trial.

The plaintiffs request a trial by jury and seek judgment in an amount that is fair and reasonable, plus costs, and for such further relief as the Court may deem just and proper. They are represented by Michael E. Kaemmerer and Contessa A. Brundridge of McCarthy, Leonard, Kaemmerer LC in St. Louis.
