Woman claims owners of St. Louis apartments failed to make repairs to bathroom

ST. LOUIS — A woman is suing St. Louis apartment owners for allegedly failing to maintain the property in a safe manner.

Tamara J. Scaff filed a complaint in the St. Louis 22nd Judicial Circuit Court against Roger D. Huddleston and Katherine A. Huddleston, alleging the defendants failed their duty to be responsible in operating and maintaining their rental premises in a safe and habitable condition.

According to the complaint, the plaintiff alleges that on July 12, 2015, she was visiting a friend who is a tenant of the defendants' apartments when she slipped and fell inside the bathroom barefoot due to a standing water that had pooled from the leaking toilet onto the tile floor. Scaff claims she had surgery on her injured foot, incurred medical expenses and suffered extensive pain and suffering and social isolation. 

The plaintiff holds Roger Huddleston and Katherine Huddleston responsible because the defendants allegedly failed to repair the broken toilet, permitted the condition of the malfunctioning toilet to get worse, failed to warn of the flooded bathroom floor and failed to ensure the property was routinely maintained and repaired.

The plaintiff seeks judgment in an amount in excess of $300,000 along with pre- and post-judgment interest, costs, expenses, attorneys' fees, for punitive damages in an amount in excess of $1,000,000 and for any and all such further relief the Court deems just and proper.
