ST. LOUIS — An employee is suing a business owner and a construction company, citing alleged failure to protect while performing his duties as an employee.
James Nausley filed a complaint Aug. 1 in the St. Louis 22nd Judicial Circuit Court against Marchand Construction Inc., Nathan Marchand, individually and Ward & Park Inc., alleging the defendants failed their duty to possess and maintain workers' compensation coverage.
According to the complaint, the plaintiff alleges that on Feb. 18, 2016, he fell out of a second story doorway while working for the defendants. As a result, Nausley claims he suffered physical injuries and pain and incurred medical expenses.
The plaintiff holds the defendants responsible because they allegedly failed to maintain a safe working environment for employees, failed to provide adequate fall protection and failed to keep the work area free from hazardous conditions.
The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $25,000, together with costs, interest and any other relief deemed appropriate. He is represented by Reed C. Nelson of Nelson & Nelson in Belleville, Illinois.
