Labor trustees claim King O'Tiles failed to pay contributions

ST. LOUIS — Trustees are suing flooring contractors, citing alleged violation of workers' compensation acts.

St. Louis-Kansas City Carpenters Regional Council, Renee Bell, Ken Stricker, Robert Calhoun, et al. filed a complaint Aug. 16 in the U.S. District Court for the Eastern District of Missouri Eastern Division against King O'Tiles Inc., alleging the flooring contractors violated the Employee Retirement Income Security Act (ERISA).

According to the complaint, the plaintiffs allege that as employees bound by a collective bargaining agreement, they failed to receive employee contributions under the pension trust, the welfare trust, and the vacation trust. 

The plaintiffs hold King O'Tiles responsible because the defendant allegedly failed and refused to make all obligated contributions to the funds and to forward to the union all the deducted dues despite demands for appropriate payment.

The plaintiffs seek judgment for all amounts owed, requiring to submit all reports and make all payments in the future to the plaintiffs in accordance with the collective bargaining agreement and other relief the court considers appropriate. They are represented by Greg A. Campbell of Hammond and Shinners PC in St. Louis.
