ST. LOUIS — Consumers have filed a class-action lawsuit against talcum powder manufacturers, citing alleged negligent misrepresentation.
Amy Johnson, Patricia Adolf, Magda Avestisyan, Judith Baran and others, individually and on behalf of all others similarly situated, filed a complaint in the St. Louis Circuit Court against Johnson & Johnson Consumer Inc., PTI Royston LLC, doing business as Pharma Tech Industries, et. al., alleging they violated the federal Food, Drug and Cosmetic Act.
According to the complaint, the plaintiffs allege that as a result of using the defendants' Baby Powder and Shower to Shower products, they developed ovarian cancer. They claim they have endured severe and permanent pain and suffering and loss of enjoyment of life, and incurred medical expenses and other economic damages.
The plaintiffs hold the defendants responsible because they allegedly unreasonably developed, manufactured and sold dangerous and defective products and intentionally misrepresented, advertised and marketed that talc is safe for human use.
The plaintiffs request a trial by jury and seek judgment against each defendant in excess of $25,000, plus interest, costs for this action and any further relief deemed appropriate.
