ST. LOUIS — A St. Louis consumer is suing a bank, citing alleged nuisance and invasion of privacy.

Judy Ann Willburn filed a complaint Aug. 18 in the U.S. District Court for the Eastern District of Missouri against Credit One Bank NA, alleging it violated the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that since November 2015, she has received approximately 100 calls from the defendant attempting to collect an alleged credit card debt even though she never had a credit card with the company. As a result, she claims has suffered actual damages and was harassed. The plaintiff holds Credit One Bank responsible because the defendant allegedly made calls using an automatic telephone dialing system and pre-recorded voice and without her consent.

The plaintiff seeks judgment against the defendant for statutory, punitive and actual damages and other relief the court deems just. She is represented by D. Todd Mathews of Gori Julian & Associates PC in Edwardsville, Illinois, and Amanda J. Allen of The Consumer Protection Firm in Tampa, Florida.
