CAPE GIRARDEAU — A customer is suing a retail store operator, citing alleged negligence.
Hope Arnold, formerly known as Hope Evans, filed a complaint Aug. 24 in the U.S. District Court for the Eastern District of Missouri Southeastern Division against Dollar Tree Stores Inc., alleging it breached its duty to maintain its premises in a reasonably safe condition.
According to the complaint, the plaintiff alleges that on Dec. 7, 2015, she was at defendant's store in Kennett. Upon stepping into the women’s restroom, she slipped in the puddle of urine and fell to the ground. She sustained serious injuries to her shoulder and knee resulting in physical pain, mental anguish and medical expenses. The plaintiff holds Dollar Tree Stores responsible because the defendant allegedly negligently failed to eliminate the dangerous condition and failed to warn its customers of the existence of such condition.
The plaintiff requests a trial by jury and seeks damages of more than $75,000, plus interest, cost of the suit and further relief the court deems proper. She is represented by Jonathan D. Valentino and Todd R. Nissenholtz of Cofman Townsley LLP in Clayton.
