Leatherman Tool Group accuses Missouri corporation of patent infringement

Patents 01

ST. LOUIS — A manufacturing company is suing a Missouri corporation, citing alleged patent infringement.

Leatherman Tool Group Inc. filed a complaint Aug. 18 in the U.S. District Court for the Eastern District of Missouri against King Technology of Missouri Inc., doing business as King Innovation, alleging that the defendant continues to use patented products without authorization or consent.

According to the complaint, the plaintiff alleges that it has obtained multiple patents to protect the functional and ornamental features of its multitools. As the lawful owner of all right, title, and interest to all patented products, the plaintiff claims the defendant's continued use of patent products has resulted in damages and confusion to consumers and loss of income.

The plaintiff alleges the defendant has directly infringed on at least one of the patent products by making, using, selling and/or offering to sell the products in the United States.

The plaintiff requests a trial by jury and seeks compensation for damages; order to permanently enjoining King from continuing to make, use, sell or offer to sell the I-tool product in the U.S.; and award of attorney fees, costs and for further relief the court deems appropriate. The plaintiff is represented by James F. Bennett and John J. Rehmann II of Dowd Bennett LLP in St. Louis and Michael S. Connor and Richard M. McDermott of Alston & Bird LLP in Charlotte, North Carolina.
