Driver claims Richardson Masonry, others failed to keep construction site safe after scaffolding fell on car

ST. LOUIS — A St. Louis County driver is suing construction companies, citing alleged negligence in keeping public construction safe.

Gregory Dixson filed a complaint Aug. 25 in the St. Louis 22nd Judicial Circuit Court against Richardson Masonry LLC, John Doe Scaffolding Co. and John Doe Engineering Firm, alleging that the defendants failed to exercise ordinary care in keeping workplace safe for public individuals passing it.

According to the complaint, the plaintiff alleges that on Aug. 18, 2015, he was driving near the defendant's work site when scaffolding, sheeting and power lines fell onto his vehicle during a storm. Because the power lines were live, the defendant jumped from his truck, sustaining damages and injuries, the complaint said. The plaintiff alleges scaffolding was improperly erected, poorly constructed and dangerous in wind and other weather conditions. 

As a result, Dixson claims he suffered bodily injuries and psychiatric trauma and incurred medical expenses. 

The plaintiff holds the defendants responsible because they allegedly failed to inspect and maintain the scaffold, failed to clear the sidewalk and street adjacent to the scaffold and failed to use ordinary care to barricade, remove, or warn of the dangerous condition of the scaffold.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $25,000 for damages sustained, for all costs expended, prejudgment interest and further relief the court deems necessary. He is represented by Kurt E. Wolfgram of Wolfgram & Associates PC in St. Louis.
