Couple claims hip replacement system from Missouri company, others was defective

ST. LOUIS — A couple is suing manufacturers of M2a Magnum Metal-on-Metal hip system, citing alleged design defect and breach of implied warranty.

Elizabeth and Ronald Sones filed a complaint on Aug. 25, in the St. Louis 22nd Judicial Circuit Court against Zimmer Biomet Holdings Inc. formerly known as Biomet Inc., Biomet Orthopedics LLC, Select Orthopedics Inc., et al., alleging that the defendants failed their duty to use reasonable care in the design, manufacture, promotion, marketing, sales, supply, distribution and service of magnum systems.

According to the complaint, the plaintiffs allege that on Oct. 26, 2007, Elizabeth Sones underwent surgery on her left hip and received implants with a number of the defendants' Biomet M2a Magnum components. After her left hip revision, she was found to have conditions consistent with a pseudotumor. The magnum biomet metal head was disengaged that left her with a long rehabilitation, scar tissue in her hip and emotional trauma.

The plaintiffs hold the defendants responsible because they allegedly failed to provide reasonable, complete and accurate information to patients, orthopedic surgeons and the orthopedic community regarding the effects of Magnum systems.

The plaintiffs request a trial by jury and seek judgment for compensatory damages for an amount that is fair and reasonable for all the injuries sustained, for costs, expenses, punitive damages and other relief the court deems proper. They are represented by Brian S. Franciskato and Randy James of Nash & Franciskato Law Firm in Kansas City and Altom M. Maglio and Ilyas Sayeg of Maglio Christopher & Totale PA in Sarasota, Florida.
