Missouri companies, others accused of failing to warn of asbestos risks

ST. LOUIS — A laborer is suing various corporations, citing alleged failure to warn of the harmful effects of asbestos-containing products.

David Silva filed a complaint Aug. 24 in the St. Louis 22nd Judicial Circuit Court against CBS Corp.; FMC Corp.; Foster Wheeler LLC; Gardner Denver Inc., et al., alleging that the defendants manufactured, sold and distributed asbestos-containing products that were defective and unreasonably dangerous to individuals exposed to it.

According to the complaint, the plaintiff alleges that between 1968 and Dec. 5, 1980, he was exposed to asbestos-containing products while working for Missouri-based companies and others that attributed to his lung cancer dianosis. 

As a result, Silva claims he suffered permanent injuries, mental anguish and loss enjoyment of life and has incurred hospital expenses. 

The plaintiff holds the defendants responsible because they allegedly failed to provide adequate warnings to people working with or around the products of the dangers of inhaling, ingesting or otherwise absorbing the asbestos fibers contained in them.

The plaintiff requests a trial by jury and seeks judgment for actual and compensatory damages in excess of $25,000, including costs of action and other relief that the court deems just and equitable. He is represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
