Man claims Midwest Geriatric Management withdrew employment offer after learning his orientation

ST. LOUIS — A Madison County, Illinois, man is suing a Missouri-based nursing home company, citing alleged fraudulent inducement and discrimination.

Mark Horton filed a complaint in the U.S. District Court for the Eastern District of Missouri against Midwest Geriatric Management LLC, alleging the defendant withdrew its offer of employment, which plaintiff had already accepted, after learning he is married to a man and refused to reconsider him for the position.

According to the complaint, the plaintiff alleges that on May 17, 2016, after disclosing his relationship in passing to the defendant, the plaintiff allegedly experienced discrimination when his application as vice president of human resources and regional sales manager position was denied, despite signing an employment offer and communicating with the defendant.

The plaintiff holds Midwest Geriatric Management responsible because the defendant allegedly failed and refused to exercise reasonable care to prevent and promptly correct the unlawful employment practices amounted to condonation, ratification, approval and/or perpetuation of unlawful conduct.

The plaintiff requests a trial by jury and seeks to be award of compensatory and punitive damages, costs of action and other relief the court deems proper. He is represented by Mark S. Schuver and Natalie T. Lorenz of Mathis, Marifian & Richter LTD in Belleville, Illinois.
