Supplier claims Palmer Natural Products refused delivery of items

ST. LOUIS — An ingredient supplier is suing a manufacturer of dietary supplements, citing alleged breach of contract.

Creative Compounds LLC filed a complaint in the U.S. District Court for the Eastern District of Missouri against Leach & Perrett Inc., doing business as Palmer Natural Products, alleging the defendant failed to perform all obligations required under a contract.

According to the complaint, the plaintiff alleges that on March 10, 2015, both parties agreed to a contract in which the defendant will purchase the plaintiff's D-biotin products in six separate shipments at the rate of $850 per kilogram. When the market price for pure D-biotin dropped, the defendant allegedly stopped taking deliveries of the product that the plaintiff had sourced. 

The plaintiff holds the defendant responsible because it allegedly failed and refused to accept delivery despite the plaintiff's alleged efforts to convince the company to abide by the terms of their contract.

The plaintiff requests a trial by jury and seeks to be award of damages in an amount to be determined at trial, plus costs, attorneys' fees, pre and post-judgment interest, and such further relief as it deems just and proper.
