Man accuses St. Peters shopping plaza operators of failing to abide by ADA guidelines

ST. LOUIS — A Johnson County, Indiana, individual is suing the owner, lessee and operator of a shopping plaza, citing alleged disability discrimination.

Dennis Tooley filed a complaint in the U.S. District Court for the Eastern District of Missouri Eastern Division against The Grewe Limited Partnership, JBR Realty Co., Toys R US Property Company II LLC and Takarofus LP, alleging the defendants violated the Americans with Disabilities Act (ADA).

According to the complaint, the plaintiff alleges that he visited the defendant's property in St. Peters and encountered architectural barriers on the premises. The plaintiff has progressive multiple sclerosis and requires the use of a wheelchair for mobility. He claims the barriers encountered have endangered his safety, impaired his ability to park a vehicle and impaired his ability to access the property. 

The plaintiff alleges the defendants failed to make reasonable modifications in policies, practices or procedures in compliance with the provisions of the ADA and failed to assist people with disabilities.

The plaintiff requests a trial by jury and seeks an order directing to alter the facility usable by individuals with disabilities and award of attorneys' fees, costs and litigation expenses, and other relief the court deems proper.
