Car accident 09

ST. LOUIS — Vehicle occupants are suing a sheriff's department and employee, citing alleged negligence.

Donrico Humphrey and Demetrius Moore filed a complaint Sept. 5 in the St. Louis Circuit Court against Marvin McCutcheon and Ste. Genevieve County Sheriff's Department, alleging the Sheriff's Department failed to properly train its employee on safe driving.

According to the complaint, the plaintiffs allege that on Feb. 22 they sustained permanent and progressive injuries to their heads, necks, backs and shoulders when the vehicle they were in, which was parked on the shoulder of South Tucker Boulevard, was struck by a Sheriff's Department truck driven McCutcheon. They claim they have suffered physical and mental pain and lost wages and benefits, and incurred medical expenses. The plaintiffs hold McCutcheon and Ste. Genevieve County Sheriff's Department responsible McCutcheon allegedly failed to keep a careful lookout and failed to reduce speed or stop to avoid a collision.

The plaintiffs request a trial by jury and seek judgment against defendants in an amount within the jurisdictional limits of the court, plus interest, cost of this suit and other relief the court may deem proper. They are represented by John L. Wlbers of The Wilbers Law Firm LLC in St. Louis.
