Mother accuses D Trans of breaching settlement agreement

ST. LOUIS — A mother is suing a trucking company, citing alleged breach of settlement agreement.

Dana Malone, as surviving mother of Tyler Pierce-Earl, deceased, filed a complaint Sept. 7 in the St. Louis Circuit Court against D Trans Inc., alleging that the trucking company failed to perform its obligations under the agreement.

According to the complaint, the plaintiff alleges that as a result of the death her son, Pierce-Earl, due to an accident allegedly caused by defendant's employee, the defendant agreed to pay the plaintiff $25,000. To date, said amount has not been settled. The plaintiff holds D Trans responsible because it allegedly failed to make payments for that amount.

The plaintiff seeks judgment in the amount of $25,000 and further relief the court deems appropriate. She is represented by Andrea A. Stanley and James R. Cantalin of Brown & Crouppen PC in St. Louis.
