Missouri man claims he developed lung cancer due to asbestos exposure

ST. LOUIS — A husband and wife from Missouri are suing asbestos products manufacturers, citing alleged negligence.

Daniel J. Kory and Laverne Kory filed a complaint in the St. Louis 22nd Judicial Circuit Court against A.W. Chesterton Co., Alcatel-Lucent USA Inc., Allied Paint and Wallpaper Co. Inc. and others, alleging they breached their duties to exercise ordinary care and caution for the safety of others.

According to the complaint, the plaintiffs allege that during the course Daniel Kory's employment beginning in 1954, he was exposed to and inhaled or ingested asbestos fibers from certain products manufactured, sold, distributed or installed by the defendants. On Aug. 2, he first became aware that he developed lung cancer, due to asbestos exposure. He claims he was first exposed to asbestos in St. Louis.

The plaintiffs hold the defendants responsible because they allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiffs request a trial by jury and seek compensatory damages of more than $25,000, plus costs, interest and any further relief the court deems appropriate. They are represented by Paul M. Dix, Todd A. Nielson and Courtney Gregory of Simmons Hanly Conroy in Alton, Illinois.
