Progressive Direct accuses driver of negligence in St. Louis crash

ST. LOUIS — An insurance company is suing a vehicle driver, citing alleged negligence in a collision.

Progressive Direct Insurance, as subrogee of Deandre L. Davis, filed a complaint Sept. 21 in the St. Louis 22nd Judicial Circuit Court against Charnee Monique Anderson, alleging that the defendant failed her duty to the insured to operate her vehicle in safe and non-negligent manner.

According to the complaint, the plaintiff alleges that on Dec. 30, 2012, its insured vehicle driven by Bianca Ricks was involved in a collision when Anderson struck Ricks' vehicle while driving on North Grand Avenue near North Market Street in St. Louis.

As a result, the plaintiff claims it paid $143,000 for medical bills to the insured and her passenger, Breonna Partee. 

The plaintiff holds Anderson responsible because the defendant allegedly failed to maintain a proper lookout and failed to maintain control of her vehicle.

The plaintiff requests a trial by jury and seeks judgment in the amount of $114,400 plus post-Petition interest at the statutory rate, plus Court costs, and for such other and further relief as the Court deems just and proper. They are represented by Erin J. Kooiker of Wetsch Abbott Osborn Van Vliet, PLC in Des Moines, Iowa.
