ST. LOUIS — A St. Louis property owner is suing a manager and real estate company, citing alleged breach of contract due to wrongful foreclosure.
Julie Althide filed a complaint Sept. 25 in the St. Louis 22nd Judicial Circuit Court against Advent Properties LLC and Latham Bell, alleging the defendants violated the Missouri Merchandising Practices Act.
According to the complaint, Althide alleges that on Sept. 7, she received notice that the defendants requested foreclosure and that a trustee's sale of her property had been scheduled for Sept. 27. The plaintiff claims that the reason for initiating the foreclosure sale arose from an alleged default, which allegedly was due to declining personal relations between Althide and Bell.
The plaintiff holds Advent Properties and Bell responsible because the defendants allegedly failed to provide the property owner with the required legal notices before initiating foreclosure and scheduling a trustee's sale and failed to comply with all the agreed terms in the contract.
The plaintiff requests a trial by jury and seeks to temporarily and permanently enjoin and restrain from taking any further action to foreclosure on the property, award attorney fees, costs, interest and other relief the court deems just and proper.
