Driver seeks payment from insurance company, motorist in Grand Boulevard crash

ST. LOUIS — A motorist is suing a driver and insurance company, citing alleged negligence and breach of contract.

Frankie Ramirez-Enet filed a complaint Sept. 25 in the St. Louis 22nd Judicial Circuit Court against American Family Mutual Insurance Co. and Toma Read, alleging that the defendants failed their duty to provide uninsured insurance coverage after Ramirez-Enet's vehicle was struck, resulting in injuries.

According to the complaint, the plaintiff alleges that on Sept. 26, 2012, she was driving north on Grand Boulevard in St. Louis when her vehicle was struck by Read after an unidentified driver, who was uninsured, hit the defendant's vehicle. The plaintiff claims the insurance contract with American Family Mutual Insurance was in effect during the accident and covered claims for uninsured motorist coverage. 

The plaintiff holds the defendants responsible because Read allegedly failed to exercise the highest degree of care to keep a careful lookout and drove at an excessive rate of speed.

The plaintiff seeks judgment for over $25,000 for loss and damage, together with costs expended and other relief the court deems just and proper. The plaintiff is represented by R. Tyson Mutrux of The Mutrux Law Firm in St. Louis.
