US Foods claims it didn't receive payment for delivered goods

ST. LOUIS — A food-service distributor is suing a number of companies, citing alleged breach of customer account agreement and guaranty.

US Foods Inc. filed a complaint Sept. 27 in the St. Louis Circuit Court against Bloomington Nursing & Rehab, Corydon Nursing & Rehab Center, Essex Nursing & Rehab and others, alleging they failed to perform their obligations under a contract.

According to the complaint, the plaintiff alleges that beginning in 2014, it supplied various foods and other food-related products and services to the defendants. The defendants collectively owe the plaintiff approximately $286,988.03, the plaintiff claims. 

The plaintiff holds the defendants responsible because they allegedly ordered, received and accepted delivery of goods and services provided by plaintiff but refused to pay the same.

The plaintiff seeks judgment against defendants for all damages, attorneys' fees, litigation expenses and any further relief the court deems just. It is represented by Cullen K. Kuhn and Laura Uberti Hughes of Bryan Cave LLP in St. Louis.
