St. Louis property owners accuse insurer of failing to pay claims after water-main break

ST. LOUIS — St. Louis property owners are suing an insurance company, citing alleged refusal to pay.

HH St. Louis Railway LP and Railway Exchange Owner LLC filed a complaint Sept. 21 in the St. Louis Circuit Court against Affiliated FM Insurance Co., alleging it denied its obligation to pay the full amount of coverage.

According to the complaint, the plaintiffs allege that on Nov. 13, 2016, their properties were severely damaged by water and sludge after the rupture of a water main between Sixth and Seventh streets. The plaintiffs claim they have suffered direct damages and other consequential damages in an amount to be determined at trial because the insurer failed to cover the damage. The plaintiffs hold Affiliated FM Insurance responsible because the defendant allegedly wrongfully denied and refused to promptly provide coverage under the all-risk property insurance policy.

The plaintiffs request a trial by jury and seek compensatory, actual and consequential damages, attorneys' fees, costs and additional relief the court deems just. They are represented by Katie C. Pawitz of Reed Smith LLP in Washington, D.C.
