St. Louis couple claims neighbors obstructed their property

ST. LOUIS — A St. Louis couple is suing homeowners, citing alleged deliberate intent to impede the use of their own property.

Robert and Deborah Dolgin filed a complaint Sept. 28 in the St. Louis 22nd Judicial Circuit Court against Thomas and Adele Daake, alleging they intentionally interfered with the ingress and egress to the plaintiffs' residence.

According to the complaint, the plaintiffs allege that in spring 2017, the defendants placed concrete-filled traffic cones, concrete-filled buckets, push carts filled with concrete and other obstructions on the property line and adjacent to the plaintiffs' residence, thereby causing them limited use of their own driveway and their property. 

The plaintiffs hold the defendants for allegedly interrupting and intentionally blocking the property owners access to their property and removed them of their right to establish a private road in favor of their own property.

The plaintiffs seek order and declaration of the right to cross their property, an award of attorneys' fees, costs incurred and other relief as the court deems proper. They are represented by Roger W. Pecha, Jason M. Rugo and Laura M. Robb of Jenkins & Kling PC in St. Louis.
