Worker claims restaurant operators violated Missouri wage law

ST. LOUIS — A worker is suing operators of restaurants, citing violation of workers' compensation acts.

Quentin McKinnie filed a complaint Sept. 27 in the St. Louis Circuit Court against Roya Moshiri and Healthy Meal Creations, Inc. alleging that the defendants violated the Missouri's Minimum Wage Law (MMWL).

According to the complaint, McKinnie alleges that between 2012 and 2016 he worked for the defendants. From 2014 to December 2016, he was a full-time employee and agreed on $10 per hour for a maximum of 80 hours per two-week period and a rate of 1.5 times the regular rate per hour for hours worked over 80. The plaintiff claims he was underpaid and the defendants allegedly orchestrated schemes to improperly withhold money from most paychecks.  As a result, McKinnie claims he had to take out loans to cover his expenses. 

The plaintiff alleges the defendants failed to pay the agreed-upon hourly wages, failed to pay the minimum wage required by the MMWL and refuses to pay a substantial number of both regular and overtime hours over a two-year period.

The plaintiff requests a trial by jury and seeks damages consisting of unpaid regular wages, unpaid overtime wages, consequential damages and all other relief the court deems just. He is represented by Richard A. Voytas and Nathan E. Ross of Ross & Voytas LLC in St. Louis.
