ST. LOUIS — A food preparer is suing a food company and its director, citing alleged breach of contract due to unpaid wages.

Christopher Walter filed a complaint Oct. 5 in the St. Louis 22nd Judicial Circuit Court against Roya Moshiri and Healthy Meal Creations Inc., alleging the defendants violated the Missouri's Minimum Wage Law (MMWL).

According to the complaint, the plaintiff alleges that between 2012 and May 2016, he worked full-time with the defendants at agreed rate per hour for standard hours and a rate of 1.5 times per hours worked in excess of 80 hours per two-week period. Despite performing his duties, the plaintiff claims he was paid less than he was owed and failed to receive proper overtime compensation. He claims the defendants offered a loan to help with personal expenses, with interest deducted from his paycheck.

The plaintiff holds Roya Moshiri and Healthy Meal Creations responsible because the defendants allegedly failed to pay for many hours worked, failed to pay minimum wage required by the MMWL and failed to keep a summary of time records and overtime hours that the employee actually worked.

The plaintiff requests a trial by jury and seeks to award of damages consisting of the unpaid wages, unpaid overtime wages, consequential damages and other relief the court deems just and proper. He is represented by Richard A. Voytas and Nathan E. Ross of Ross & Voytas LLC in St. Louis.
