St. Louis consumers, others claim Roundup use caused illness

Cancer

ST. LOUIS — Consumers from St. Louis and elsewhere are suing the makers and distributors of Roundup, citing alleged design defects and failure to warn users of its harmful effects.

Jeanne Ferretti, Henry Acosta, Gail Alpern, Charles Ausfahl, Frederick Baker, et. al. filed a complaint Oct. 5 in the St. Louis 22nd Judicial Circuit Court against Monsanto Co., Osborn & Barr Communications Inc., Osborn & Barr Holdings Inc., alleging that the defendants failed its duty to properly test, develop, design, manufacture, inspect, package, label, market, promote, sell, distribute, maintain supply, provide proper warnings and take the necessary steps to ensure that its Roundup products did not cause users any harm.

According to the complaint, consumers allege that they or others have been diagnosed with non-Hodgkin lymphoma as a result of Roundup exposure. The plaintiffs claim the product contains the active ingredient glyphosate and the surfactant polyethoxylated tallow amine, which they claim is dangerous to human health.

The plaintiffs hold the defendants responsible because they allegedly failed to investigate, study, test or promote the safety or to minimize the dangers to users and consumers of its product, failed to exercise reasonable care to warn of the dangerous risks associated with use and exposure to the product and wrongfully concealed information concerning the dangerous nature of Roundup.

The plaintiffs request a trial by jury and seek judgment for compensatory damages in the amount in excess of $75,000 and such further relief as court deems just. They are represented by James G. Onder, W. Wylie Blair and Mark E. Berns of The Onder Law Firm in St. Louis and R. Brent Wisner, Michael L. Baum and Frances M. Phares of Baum Hedlund Aristei & Goldman PC in Los Angeles.
