Two people accused of misrepresenting St. Louis property before sale

ST. LOUIS — An individual is suing property owners, citing alleged fraudulent misrepresentation and unjust enrichment.

Elton P. Wise filed a complaint Oct. 4 in the St. Louis 22nd Judicial Circuit Court against Ezekiel Moore and Chela Moore, alleging the defendants failed their duty to disclose the defects in the condition of the property to get the client to buy the property.

According to the complaint, Wise alleges that in July 2016, he negotiated the sale of the defendant's property for $290,000. The plaintiff claims the property was falsely represented to have no known defects and no code violations that needed to be rectified prior to the sale. 

As a result, Wise claims he has been damaged in the sum of $30,000 for repairs and fines associated with the fraudulent nondisclosure. 

The plaintiff holds Ezekiel Moore and Chela Moore responsible because the defendants allegedly failed to disclose the defects during the negotiations for the property and failed to disclose that they had been cited by the city of St. Louis for various violations.

The plaintiff seeks restitution of all payments and consideration given thereunder, for consequential damages, costs, attorney fees and further remedies as the court deems just and necessary. He is represented by Herman L. Jimerson of Jimerson Law Firm PC in Clayton.
