ST. LOUIS — A vehicle passenger is suing a motorist, citing alleged negligence.
Susan Grooms filed a complaint Sept. 27 in the St. Louis Circuit Court against Joseph Hayes, alleging he breached his duty to exercise the highest degree of care in operating his motor vehicle.
According to the complaint, the plaintiff alleges that on March 15, 2016, she was a passenger in a vehicle driven by her husband traveling southbound on North Theresa Avenue in St. Louis when the defendant, who was traveling eastbound on Washington Avenue, negligently entered the intersection and crashed into her vehicle. As a result, she claims she sustained injuries to her neck, back, head, chest and other areas, resulting in physical and mental pain, medical expenses and loss of mobility.
The plaintiff holds Hayes responsible because the defendant allegedly negligently drove his vehicle at an excessive rate of speed, failed to slow down and negligently attempted to make a U-turn when it was unsafe to do so.
The plaintiff requests a trial by jury and seeks damages in excess of $25,000, costs of this action and any further relief as the court may deem just and proper. She is represented by Justin C. Wilson and Brad L. Elkin of Brown & Crouppen PC in St. Louis.
