ST. LOUIS — The Metropolitan St. Louis Sewer District is suing Charter Communications LLC and Utilibore Inc., which installs communications cables, over damage to a sewer line.
The sewer district filed the complaint on Oct. 6, in the St. Louis Circuit Court against the defendants, alleging that they failed to exercise reasonable care in the construction, installation and placement of communication cables along a public right-of-way.
According to the complaint, the plaintiff alleges that, beginning in April 2012 up until the cables were removed, the sewer line incurred damage, resulting in a temporary loss of capacity and use of the sewer main and expenses of approximately $94,944.30 for repairs. The plaintiff holds Charter Communications LLC and Utilibore Inc. responsible because the defendants allegedly negligently drilled and placed the cables along the plaintiff's sewer main without the plaintiff's consent or permission.
The plaintiff requests a trial by jury and seeks damages of not less than $94,944.30, plus interest, attorneys' fees, court costs and any further relief that the court may deem proper. The district is represented by its own lawyer, Kenneth D. Goins.
