ST. LOUIS — An Indiana couple are suing ABP Induction LLC, Brand Insulations Inc., Bryant Heating and Cooling Systems and other companies involved with asbestos products, alleging that negligence led to the husband's health problems.
Roger L. Roth and Arora F. Roth filed a complaint on Oct. 17 in the St. Louis Circuit Court against the defendants, alleging that they failed to exercise reasonable care for the safety of others.
According to the complaint, the plaintiffs allege that at various times during Roger Roth's employment from 1953 to 1998, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants. The complaint alleges that on or about Oct. 27, 2016, they first became aware that he developed mesothelioma, an asbestos-induced disease. Because he had to undergo medical care and treatment, the couple was compelled to expend large sums of money for necessary health care services.
The plaintiffs hold ABP Induction LLC, Brand Insulations Inc., Bryant Heating and Cooling Systems and scores of other companies responsible because the defendants allegedly included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
The plaintiffs seek damages of more than $50,000 and for any further relief that the court deems appropriate. They are represented by Jackalyn A. Olinger Rochelle and T. Barton French Jr. of Maune, Raichle, Hartley, French & Mudd LLC in St. Louis.
