Driver claims his vehicle was rear-ended on Highway 70 exit ramp

ST. LOUIS — A driver is suing another motorist, citing alleged negligence.

Theodore Smith filed a complaint Oct. 18 in the St. Louis Circuit Court against Carlois McCall, alleging McCall failed to keep his vehicle under proper control.

According to the complaint, the plaintiff alleges that on May 6, he was driving onto an exit ramp at westbound Highway 70 when the defendant negligently caused the vehicle he was driving to strike the rear of the plaintiff's vehicle. Asa result, the plaintiff claims he sustained injuries to his head, neck, shoulders and other parts of his body, resulting in medical expenses, lost earnings and physical impairment. 

The plaintiff holds McCall responsible because the defendant allegedly negligently failed to maintain a careful lookout and failed to stop or slow his speed to avoid a collision.

The plaintiff requests a trial by jury and seeks damages between $25,000 and $75,000, plus costs of this action and all further relief the court deems just and proper. He is represented by Theodore H. Hoffman of Hoffman & Gelfman Attorneys PC in St. Louis.
