Couple seeks judgment for alleged asbestos exposure from Missouri firms, others

ST. LOUIS — A husband and wife are suing a number of companies, citing alleged negligence.

Dwight Dittmar and Judy Dittmar filed a complaint Oct. 13 in the St. Louis 22nd Judicial Circuit Court against Advance Auto Parts Inc., Air & Liquid Systems Corp., Belden Wire & Cable Co. and others, alleging they breached their duties to exercise reasonable care for the safety of others.

According to the complaint, the plaintiffs allege that during the course of Dwight Dittmar's work from 1959 to 1980, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants. On Nov. 13, 2014, he was diagnosed with lung cancer, which the suit claims was a result of asbestos exposure, and that the disease was wrongfully caused. He has been and will continue to spend large sums of money for medical care and services necessary for his treatment, the complaint states. 

The plaintiffs hold the defendants responsible because they allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiffs seek judgment against the defendants in excess of $25,000, costs of this action and any other relief that is just and equitable. They are represented by Benjamin R. Schmickle and Matthew C. Morris of SWMW Law LLC in St. Louis.
