ST. LOUIS — A motorist is suing another driver, citing alleged negligence.
Perry Mudd filed a complaint Oct. 13 in the St. Louis Circuit Court against Rebecca Fleak, alleging she breached her duty to exercise the highest degree of care in the operation of her motor vehicle.
According to the complaint, the plaintiff alleges that on July 8, he was driving northbound on South Compton Avenue at its intersection with Russell Boulevard when the defendant violently struck his vehicle. He claims he sustained physical injuries and extensive property damage. He suffered severe and permanent injuries to his head and neck, resulting in pain, disability, disfigurement and medical expenses, the complaint states.
The plaintiff holds Fleak responsible because the defendant allegedly failed to keep a careful lookout, failed to yield right of way and failed to stop, swerve or reduce speed to avoid a collision.
The plaintiff requests a trial by jury and seeks judgment in his favor for damages in excess of the jurisdictional limits of the court, plus interest, costs of court and all further relief as the court may deem just and proper. He is represented by Mark T. McCloskey and Patricia N. McCloskey of McCloskey PC in St. Louis.
