Widow accuses Crane Co., others of wrongful death due to asbestos exposure

Asbestos 13

ST. LOUIS — A widow is accusing Crane Co., A.W. Chesterton Inc., AGCO Corp. and others of the wrongful death of her husband due to exposure of products containing asbestos.

Byra Lynn James filed a complaint on Oct. 20, in the St. Louis 22nd Judicial Circuit Court against the defendants, alleging that they breached their duties to exercise reasonable care for the safety of others.

According to the complaint, the plaintiff alleges that during the course of Gary P. James' work from 1969 to 2014, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by the defendants. As a result, he developed mesothelioma, an asbestos-induced disease, the complaint says, leading to his death on Oct. 29, 2014.

The plaintiff holds Crane Co. and the other defendants responsible because they allegedly included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly and severally, for damages of more than $25,000, costs of this action and any further relief the court may deem proper. She is represented by Andrew O' Brien, Christopher J. Thoron, Bartholomew J. Baumstark, Gerald J. FitzGerald and Adam J. Reynolds of O'Brien Law Firm PC in St. Louis.
