ST. LOUIS — A couple are suing CertainTeed Corp., DAP Inc., Georgia Pacific LLC and others, alleging that their negligence led to the husband's lung disease.
Lyle Orr and Patty Orr filed a complaint on Oct. 23, in the St. Louis 22nd Judicial Circuit Court against the defendants, alleging that they failed to exercise reasonable care and caution for the safety of others.
According to the complaint, the plaintiffs allege that during plaintiff Lyle Orr's construction and carpentry work, he was exposed to and inhaled or ingested asbestos fibers emanating from certain products manufactured, sold, distributed or installed by defendants. On Aug. 3, 2017, he first became aware that he developed lung cancer, an asbestos-induced disease, according to the complaint. As a result, he become liable for a large sum of money for past and future medical treatments.
The plaintiffs holds CertainTeed Corp., DAP Inc., Georgia Pacific LLC and others responsible because the defendants allegedly included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
The plaintiffs request a trial by jury and seek compensatory damages of more than $25,000 and any other relief that is just and equitable. They are represented by Wilson D. Sikes and Timothy S. O'Grady of Napoli Shkolnik PLLC in Edwardsville, Ill.
