Former employee sues HLK for fraudulent misrepresentation

ST. LOUIS — A New York resident is suing an advertising company, citing alleged fraudulent misrepresentation in its hiring process.

Brian Aitken filed a complaint on Oct. 26, in the St. Louis 22nd Judicial Circuit Court against HughesLeahKarlovic Inc., which does business as HLK, alleging that the defendant concealed the true nature of his employment with the company in order to induce Aitken to accept a junior-level position.

According to the complaint, the plaintiff alleges that on Sept. 6, 2016, he started working for defendant HLK and was informed that a senior employee was leaving the company and that this had been purposely kept secret from him. The plaintiff quickly realized that he had essentially been hired in order back-fill a junior level position and not the high-level management position that had been promised to him. Aitken was continually denied any sort of leadership role, and after his resignation, he failed to be paid his final wage, the complaint said. 

The plaintiff holds HLK responsible for allegedly making false representations regarding the true nature of his position and responsibilities and failed to pay final wages.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $25,000 for attorneys' fees, costs, interest and for any other relief the court deems proper. He is represented by John M. Moffitt III of Hollingshead & Dudley in St. Louis.
