ST. LOUIS — A vehicle driver is suing an unnamed uninsured motorist and her auto insurance company for alleged refusal to pay uninsured motorist coverage.
J'era Perry filed a complaint on Oct. 24 in the St. Louis 22nd Judicial Circuit Court against John Doe and State Farm Mutual Automobile Insurance Co., alleging that the company failed to compensate her according to the terms of her accident coverage.
According to the complaint, the plaintiff alleges that on March 30, 2016, she was travelling westbound along Interstate 70 when her vehicle was struck by the unknown driver. After sustaining injuries due to accident, the plaintiff filed an uninsured motorist claim with defendant State Farm. Despite having an active insurance policy, she failed to receive the compensation she sought, the complaint says.
As a result, Perry claims she suffered physical injury and property damage.
The plaintiff holds John Doe and State Farm Mutual Automobile Insurance Co. responsible because the State Farm allegedly failed to comply with its obligation to adequately pay the policy owner upon her submission of an uninsured motorist claim.
The plaintiff requests a trial by jury and seeks payment for the policy limit, not to exceed 20 percent of the first $1,500 of the loss and 10 percent of the amount of the loss in excess of $15,000, along with attorney fees and any further relief the court deems proper.
