Couple sue S.S. Phillips 66 over son's gun death

ST. LOUIS — A couple are suing S.S. Phillips 66 LLC, alleging that insufficient measures were taken to prevent the death of their son.

George and Dorothy Simmons, as personal representatives of the late Christopher Simmons, filed a complaint on Oct. 27 in the St. Louis Circuit Court against S.S. Phillips 66 LLC. The couple allege that the lubricant company's agents or employees breached their duties to protect their costumers.

According to the complaint, the plaintiffs allege that on Sept. 27, the defendant's store clerk/owner negligently and recklessly shot and killed the plaintiffs' son. The plaintiffs suffered pecuniary losses and funeral expenses and were deprived of the services, comfort and society of their son, the complaint says.

The plaintiffs hold S.S. Phillips 66 responsible because the defendant's employees or agents allegedly failed to exercise reasonable care and caution to protect their costumers and negligently discharged a firearm and shot Christopher Simmons.

The plaintiffs request a trial by jury and seek judgment against defendant for their pecuniary losses and any further relief the court may deem equitable. They are represented by Nuru Witherspoon of the Witherspoon Law Group in Dallas.
