Gateway Metro Credit Union sues client, State Farm

ST. LOUIS — A credit union is suing State Farm Mutual Auto Life Insurance Co. and a borrower, citing alleged fraudulent misrepresentation and negligence after a car crash.

Gateway Metro Credit Union filed a complaint on Oct. 31 in the St. Louis Circuit Court against the defendants, alleging that defendant Lacia Allen wrongfully made a claim against her car insurance policy issued by defendant State Farm.

According to the complaint, the plaintiff alleges that on Nov. 3, 2015, Gateway provided financing to the defendant to purchase a 2012 Dodge Challenger in the amount of $23,199. On Dec. 10, 2015, the vehicle was deemed a total loss after a crash while it was insured by State Farm. As a result of the defendants' actions, Gateway suffered the loss of security interest in the vehicle in the amount of the current loan balance plus interest.

The plaintiff holds State Farm and Allen responsible because State Farm allegedly negligently failed to confirm the authenticity of the release lien submitted by defendant Allen and wrongfully issued check payable to Allen.

The plaintiff requests a trial by jury and seeks damages of more than $25,000, plus interest and any further relief the court deems just. It is represented by Martin L. Daesch of the Onder Law Firm in St. Louis.
