Couple fault I.C.S. Construction Services, property owner for home damage

ST. LOUIS — A couple are suing Equity Trust Co. and I.C.S. Construction Services LLC, citing alleged negligence as the cause of roof damage to the couple's home.

Moses Regular and Casey Regular filed a complaint on Oct. 27 in the St. Louis Circuit Court against the defendants, alleging that they failed to hire competent workers to complete a residential construction project adjacent to the Regulars' property.

According to the complaint, the plaintiffs allege that on March 6, as a result of the rubble and the debris from Equity Trust's collapsed property and due to the heavy rainfall, they sustain extensive mold damage to the interior of their home. Since that day, they suffered out-of-pocket expenses for temporary living quarters, loss of privacy, stress, anxiety and were deprived of their rights to live in a quiet home.

The plaintiffs hold Equity Trust Co./Stephen A. Giufre and I.C.S. Construction Services responsible because the defendants allegedly used the Regulars' property for storage of bricks, tools and other construction materials, as well as the parapet to support the scaffolding.

The plaintiffs request a trial by jury and seek damages in an amount in excess of $25,000 and all further relief the court deems just. They are represented by Elkin L. Kistner and Joseph H. Neill of Bick & Kistner PC in St. Louis.
