Driver seeks damages from legal representative of minor driver

ST. LOUIS — A motorist is suing the legal representative of a minor driver, alleging he was negligent in his operation of a vehicle that hit her car. 

Tammy Porter filed a complaint on Nov. 2 in the St. Louis Circuit Court against Jay R. Burns, defendant ad litem for Charles Kwentus, alleging that Kwentus failed to exercise the highest degree of care in the operation of a motor vehicle.

According to the complaint, the plaintiff alleges that on May 11, she was driving her motor vehicle westbound on Oakland when Kwentus carelessly operated his vehicle and collided with her car. Porter allegedly sustained severe and permanent injuries that caused her to suffer great pain, mental anguish and necessary medical expenses. The plaintiff holds Kwentus responsible because the defendant allegedly failed to maintain proper lookout, failed to yield the right of way and failed to timely apply brakes to stop his vehicle.

The plaintiff requests a trial by jury and seeks damages of not less than $25,000, costs of this action, and all other relief that the court may deem just and proper. She is represented by Robert H. Pedroli Jr. and Eric A. Ruttencutter of Pedroli & Gauthier in Clayton.
